May alleges that qualified mental health experts concluded his age, mental illness, intoxication, and psychological condition at the time of his 1997 arrest and interrogation in Asheville, North Carolina, impaired his ability to knowingly, voluntarily, and intelligently waive his constitutional rights or provide a reliable confession.

The Supplemental Motion cites these expert affidavits in support of the claim that substantial expert medical and psychological evidence exists concerning May's mental condition and its effect on the voluntariness and reliability of his statements to law enforcement during the Buncombe County investigation. Although the affidavits were referenced in the Supplemental Motion, they were not included within the publicly available materials reviewed for this Source Verification Archive.
