May's allegation that Detective Judy Romick began interrogating the Defendant at approximately
6:20 a.m.; that she provided him a soft drink and advised him of his constitutional rights for the first
time; that the Defendant signed a rights-waiver form before questioning commenced; that the
Defendant remained shirtless and in handcuffs during the interrogation while Detective Mike
Downing sat beside him; and that the interrogation was not recorded. The cited trial testimony is
relied upon to establish the circumstances under which the Defendant received Miranda warnings
and was questioned by investigators. May relies upon this testimony to support his claim that the
