May's allegation that following his arrest, the Defendant was transported to the Asheville Police
Department and held for several hours prior to interrogation by Detectives Judy Romick and Mike
Downing. The sworn statement of APD Officer Judy Hensley is cited to establish that the
Defendant was placed in an interview room, appeared tired, repeatedly attempted to sleep, and
was kept awake while awaiting questioning by investigators. May relies upon this statement to
support his claim that the Defendant was in continuous police custody, was not free to leave, and
remained under police control for several hours before his interrogation. May further cites this
source to document Officer Hensley's observations of the Defendant's condition prior to
questioning and to support his allegation that Officer Hensley was not called as a witness during
