Lyle C. May alleges that APD Officer Darren Moore located, detained, questioned, and ultimately
handcuffed the Defendant shortly after the July 1997 murders in Asheville, North Carolina while investigating the reported assault. The
cited transcript passages are relied upon to establish Officer Moore's observations of the
Defendant, the circumstances of the detention, the questions posed to the Defendant regarding
his injuries, identity, and residence, and the officer's testimony concerning the Defendant's
custodial status. May further cites this testimony to support his claim that the Defendant was
subjected to custodial interrogation without being advised of his Miranda rights and was not free to
