Lyle C. May alleges that the physical evidence collected during the investigation of the July 1997 murders in Asheville, North Carolina, does not substantiate the conclusion that the Defendant committed the offenses. The SBI Laboratory Report is cited to establish that SBI Agent D.J. Faggart examined the alleged weapons in the case and reported that no identifiable latent fingerprints were developed or obtained. May relies upon this finding to support his argument that the forensic evidence failed to place the Defendant in physical contact with the alleged murder weapons recovered during the Buncombe County investigation and that the evidence cited by the North Carolina Supreme Court as indicating guilt did not conclusively establish that the Defendant committed the offenses.
